The Documentation Challenge
When a PC 1275 hold is placed on a bail case, families often feel blindsided. You have the money to post bail, but the court is questioning where it came from. The key is understanding exactly what documentation judges find convincing — and gathering it quickly, because every day spent preparing is another day your loved one spends in custody.
Bank Statements: The Foundation
Bank statements are the most important document in a PC 1275 hearing. Courts want to see that the funds have been in the account for a significant period — ideally 3–6 months or longer. Large recent deposits raise red flags. If the money has been sitting in the account for months and can be traced to regular payroll deposits, tax refunds, or other legitimate sources, that's a strong foundation for your case.
Employment and Income Documentation
Pay stubs, W-2 forms, and 1099s are powerful supporting documents. They establish a clear connection between the person's employment and the funds in their account. If the bail funds represent several months of savings from a documented income source, courts are generally satisfied. Self-employed individuals should bring business bank statements, invoices, and tax returns.
Property and Asset Documentation
If bail funds are coming from a home equity line of credit, a property sale, or liquidated investments, bring the relevant documentation: mortgage statements, escrow documents, brokerage statements, or sale records. Courts understand that people have legitimate assets beyond their checking accounts.
Gift Funds
If a family member or friend is providing the bail funds as a gift, the court will want a signed gift letter stating the amount, the relationship between the parties, and confirming the funds are a gift with no expectation of repayment. The gift-giver should also bring their own bank statements showing the funds in their account and their own income documentation.
Preparing for the Hearing
Organization matters at a PC 1275 hearing. Present your documents in a clear, logical order. Have copies for the judge, the prosecution, and your attorney. Chad Conley Bail Bonds works with defense attorneys regularly and can advise on what documentation package has been most effective in the specific court handling your case.
