What Is PC 646.9 — Stalking?
California Penal Code 646.9 makes it a crime to willfully, maliciously, and repeatedly follow or harass another person, and to make a credible threat with the intent to place that person in reasonable fear for their safety or the safety of their immediate family. Stalking can be charged as either a misdemeanor or a felony. It becomes a felony — with bail of $50,000 to $100,000 — when the defendant has a prior stalking conviction, when the stalking violates an existing restraining or protective order, or when the threat is particularly credible and serious. Stalking charges frequently arise from domestic relationships, workplace conflicts, and online harassment.

Protective Orders in PC 646.9 Cases
In virtually every PC 646.9 arrest, an Emergency Protective Order (EPO) is issued on the spot by the arresting officer. This EPO prohibits any contact with the alleged victim — in person, by phone, by text, by email, or through third parties. At arraignment, the judge will almost always convert the EPO into a Criminal Protective Order (CPO) lasting the duration of the case. Violating a protective order while out on bail is a separate felony charge (PC 273.6) and will result in immediate re-arrest and bail revocation. We counsel every client on these restrictions before posting bail.
PC 646.9 Arraignment — Post Bail Before the Hearing
Stalking cases often involve a history of prior contacts, restraining orders, and documented incidents that prosecutors will present at arraignment to argue for higher bail. Posting bail before arraignment locks in the booking bail amount. We post bail at all Los Angeles, San Bernardino, Riverside, and Orange County jails 24/7.
