PC 1275 Bail Hold: We Know How to Beat It
A PC 1275 hold stops your loved one's release until the court is satisfied the bail money is clean. Chad Conley Bail Bonds has navigated dozens of these hearings across Southern California — we know exactly what judges want to see.
What Is a PC 1275 Bail Hold?
Penal Code 1275 gives California courts the authority to place a hold on bail when there is probable cause to believe the funds being used to post bail were obtained through criminal activity — most commonly drug sales, theft, or fraud. When a PC 1275 hold is placed, the defendant cannot be released on bail until the source of the funds is proven legitimate at a court hearing. This is separate from the bail amount itself — even if bail is set and you have the money, you cannot post it until the hold is lifted.
PC 1275 holds are NOT automatic denials. They are a challenge — and challenges can be won.
When Do Courts Place a PC 1275 Hold?
Drug trafficking or sales charges
Any case involving HS 11351, 11352, 11378, or 11379 — courts assume drug money may be funding bail.
Large-scale theft or fraud
Grand theft, embezzlement, organized retail crime, or financial fraud arrests frequently trigger holds.
Organized crime or gang-related arrests
Courts are especially cautious when the arrest involves alleged criminal enterprise activity.
Domestic violence cases
Sometimes used in DV cases when the court has concerns about the financial relationship between parties.
Large cash bail amounts
When bail is set high and the family produces cash quickly, courts may question the source.
What Documents Lift a PC 1275 Hold?
The hearing is won or lost on documentation. Courts want to see a clear paper trail connecting legitimate income or assets to the funds being used for bail. Here is exactly what judges find convincing:
Bank statements (3–6 months)
The most important document. Courts want to see the funds have been in the account for months — not deposited recently. Regular payroll deposits are ideal.
Pay stubs and W-2 / 1099 forms
Establishes a direct link between documented employment income and the funds in the account. Self-employed? Bring business bank statements, invoices, and tax returns.
Tax returns (last 1–2 years)
Confirms consistent legitimate income over time. Especially powerful when combined with matching bank deposit history.
Property and asset records
If funds come from a home equity line, property sale, or liquidated investments — bring mortgage statements, escrow documents, or brokerage statements.
Gift letter with supporting docs
If a family member or friend is providing the funds, a signed gift letter plus their own bank statements and income documentation is required. The gift-giver must also appear at the hearing.
Business financial records
For business owners or self-employed individuals — profit and loss statements, business bank statements, and filed tax returns all help establish legitimate income.

PC 1275 Frequently Asked Questions
How long does a PC 1275 hearing take to schedule?
Typically a few days after the hold is placed, though it varies by county and court calendar. LA County courts can sometimes schedule within 2–3 days. Orange County and San Bernardino County are often similar. The sooner you call us, the sooner we can start preparing.
Can the hold be lifted before the hearing?
In some cases, yes. If the prosecution is satisfied with the documentation presented informally, they may agree to lift the hold without a formal hearing. This is less common but does happen — especially when the documentation is exceptionally clear and the defense attorney has a good working relationship with the DA's office.
What if the judge denies the PC 1275 hearing?
If the judge is not satisfied with the documentation, the hold remains in place and another hearing can be requested with additional or better documentation. This is why getting it right the first time matters — every failed hearing means more days in custody.
Does a PC 1275 hold mean the person is guilty?
Absolutely not. A PC 1275 hold is about the source of bail funds — not guilt or innocence. It is a procedural step that can be resolved with proper documentation. Many people with PC 1275 holds are ultimately acquitted or have charges reduced.
Can I use a bail bond to get around a PC 1275 hold?
No. A bail bond still requires the premium (10% of bail) to come from a legitimate source. The PC 1275 hold applies to bail bond premiums as well as cash bail. The source of the premium funds must also be proven legitimate at the hearing.
